Warranty Policy
Effective: May 18, 2026
Silient, LLC ("Silient," "we," "us," or "our") warrants its products as set forth in this Warranty Policy. This Warranty is part of, and incorporated by reference into, the Silient Terms of Sale available at silient.com/pages/terms-of-sale.
This warranty gives you specific legal rights, and you may have other rights which vary from state to state.
1. Who Is Covered
This Warranty extends to the original purchaser of a new Silient product from Silient or an authorized Silient channel (the "Owner"). For commercial installations, the Warranty also extends to the End Operator at the original installation location, provided that a Silient End Operator Acknowledgement has been duly executed and delivered to Silient. The Warranty is transferable to a subsequent owner of the original installation location upon written notice to Silient at hello@silient.com. The Warranty does not extend to users, members, guests, customers, invitees, or other occupants of the installation premises, except as Silient may expressly agree in writing. Relocation of the Product to a different installation location voids this Warranty unless Silient consents in writing.
2. Warranty Coverage
Silient warrants its products against defects in materials and workmanship under normal use and service, measured from the date of installation (or, if installation date is not documented, the date of delivery), as follows:
| Coverage | Period | Scope |
|---|---|---|
| Comprehensive (full system) | 1 year | Parts and labor. Covers all Silient-manufactured components and Silient-supplied parts of the system, including labor allowances under Section 5. |
| Cold tank | 10 years | Replacement tank component only. Labor and all ancillary costs are not covered. |
Silient will, at its sole election, (a) supply a replacement component, (b) repair the defective component, or (c) refund the pro-rated purchase price attributable to the defective component. Replacement components will be Silient original factory components or substantially equivalent components.
Important — how warranty work is performed and paid
You (the Owner) are responsible for finding and engaging a contractor to perform any warranty work. The contractor must be appropriately licensed to perform the work in the state where the installation is located. Silient does not pre-authorize, certify, or maintain a list of specific contractors.
You pay the contractor directly. Silient reimburses you, the Owner, upon receipt of a documented invoice from the contractor, in the amount of the lesser of (a) the documented invoice or (b) the applicable allowance under the Schedule of Labor Allowances in Section 5. Silient is not responsible for paying the contractor directly.
3. Tank Labor Exclusion
For the avoidance of doubt, the 10-year cold tank warranty is an exchange of a tank for a tank. Silient's obligation under the cold tank warranty is limited to provision of the replacement tank component. All labor — including but not limited to disconnection, refrigerant recovery and recharge, line-set re-braze, draining, removal, hauling, disposal, reinstallation, sanitization, and restart — and all ancillary costs (including travel, freight, permits, and inspections) are the Owner's responsibility and are not covered by this Warranty.
4. How to Claim Warranty Service
To request warranty service, contact Silient at hello@silient.com within thirty (30) days of discovering the defect. Provide:
- Name and address of the original purchaser and current owner.
- Address of installation.
- Proof of purchase (dated invoice or order confirmation).
- Model and serial number.
- Description of the issue, including photographs and service log if available.
Silient will issue a Return Materials Authorization (RMA) number and confirm whether the issue is covered by this Warranty before any reimbursable work begins. To request labor reimbursement after warranty work is performed, submit the contractor's itemized invoice (showing trade, hours, and rates) along with the RMA number to hello@silient.com. Reimbursement will be issued to the Owner of record.
Failure to provide notice within thirty (30) days shall not relieve Silient of warranty obligations except to the extent Silient is actually prejudiced by the delay. Any action arising under this Warranty must be commenced within one (1) year of the date the cause of action accrues, except where applicable law requires a longer period.
5. Schedule of Labor Allowances
The following allowances apply to reimbursement for warranty work performed during the 1-year comprehensive coverage period. Allowances are paid to the Owner upon submission of an itemized contractor invoice. Silient reimburses the lesser of the documented invoice or the applicable allowance below.
Standard contractor rates
| Contractor type | Service call fee (Diagnostic visit, includes 1st hour) |
Hourly labor rate (after 1st hour) |
After-hours / emergency rate |
|---|---|---|---|
| Plumbing | $150 | $126 / hr | $192 / hr |
| Electrical | $156 | $132 / hr | $204 / hr |
| HVAC service technician | $180 | $150 / hr | $230 / hr |
Plumbing and electrical rates above are Silient's existing published allowances. The HVAC service-technician rate reflects a reasonable national hourly rate for commercial HVAC service, plus a twenty percent (20%) adjustment.
Standard service hours by event
| Warranty event | Trade and time | Maximum allowance |
|---|---|---|
| Diagnostic call (in-warranty period) | 1 hour HVAC service technician | Service call fee ($180) |
| Valve change | 1 hour plumber | Service call fee ($150) |
| Chiller swap | 2 hours licensed plumber + 1 hour electrician | Plumbing service call + 1 hourly ($150 + $126) + Electrical service call ($156) = $432 |
| Refrigerant recovery and recharge | Documented actual cost (Section 608 certification required) | Actual cost on documented invoice |
All allowances are subject to receipt of an itemized invoice from a contractor licensed in the state of installation. Rates and conditions are reviewed periodically; updated allowances apply only to events occurring on or after the effective date of the update.
6. What Is Not Covered
This Warranty does not cover, and Silient is not liable for:
- Damage, malfunction, or failure caused by installation that does not comply with the Silient Guides, applicable plumbing, electrical, mechanical, or building codes, or accepted trade practice — provided that to the extent any aspect of the Silient product's own design or construction is itself non-compliant with applicable code, Silient remains responsible for that aspect under this Warranty.
- Damage caused by operation outside the published specifications, including (i) ambient air temperature at the unit location outside 60–80°F or (ii) chilled water setpoint outside the factory-calibrated range in the Installation Guide.
- Damage from freezing of any water-bearing component, regardless of cause.
- Damage from operation in a corrosive or contaminated atmosphere or with non-potable water supply.
- Damage from lime, scale, sediment, biological fouling, or water quality outside the published specification (≤ 250 ppm hardness as CaCO₃; pH 6.5–8.5; ≤ 50 ppm chlorides).
- Damage from modification, alteration, or repair other than routine maintenance performed in accordance with the Silient maintenance guide.
- Damage from service of the refrigerant circuit by anyone who is not certified under EPA Section 608. Handling of regulated refrigerants without proper certification is a federal violation.
- Damage from abuse, misuse, accident, fire, flood, lightning, power surge, acts of God, vandalism, or other events beyond Silient's reasonable control.
- Cosmetic damage, wear items (gaskets, seals, filters past their published life), and consumables.
- Removal, reinstallation, freight (other than as expressly provided in Section 7), permits, inspections, and disposal costs.
- Any product whose serial number has been removed, altered, or rendered illegible.
- Used, refurbished, or rebuilt products not purchased from Silient or an authorized channel.
7. Shipping
Within the 1-year comprehensive warranty period, Silient will cover the cost of shipping, both inbound and outbound, for warranty-covered components within the continental United States. After the 1-year comprehensive warranty period (including for any remaining cold tank warranty claims under Section 2), all shipping is the Owner's responsibility. For shipments to Alaska, Hawaii, U.S. territories, and Canada, Silient covers the cost of the replacement part(s) only; Owner is responsible for all shipping, customs, duties, taxes, travel, and labor costs.
8. Replacement Parts Identified During Installation and Startup
If, during initial installation and system startup, any part is found to be damaged or defective, Silient will, in its sole discretion and upon timely notice, provide a replacement part and cover the cost of shipping that replacement part. Because the cause of damage discovered at installation — for example, concealed shipping damage versus damage occurring during handling or installation — is often difficult to determine, Silient reserves the sole discretion to determine whether a part qualifies for replacement under this Section.
Silient will not pay for any labor associated with diagnosing, removing, or installing replacement parts identified during installation or startup. Such labor is the responsibility of the Owner or its installer, who is already on site for the installation.
To qualify under this Section, the damage or defect must be reported to Silient at hello@silient.com at the time of installation and startup, and in no event later than thirty (30) days after delivery, with photographs and a description. This Section is in addition to, and does not limit, the shipment-damage notice requirement in the Terms of Sale.
9. Commercial Installations — End Operator Acknowledgement
For commercial installations, continued coverage under this Warranty is conditioned on the End Operator having executed and delivered to Silient a Silient End Operator Acknowledgement before the Product was placed into service. The Owner (typically the contractor purchasing direct from Silient) is responsible under the Terms of Sale for obtaining the End Operator Acknowledgement. Operation of the Product at a commercial premises without an executed End Operator Acknowledgement on file with Silient voids this Warranty.
10. Implied Warranties
For consumer purchases in the United States: to the extent not prohibited by law, any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the duration of the applicable express warranty period stated in Section 2. Some states (including Connecticut, Kansas, Maine, Maryland, Massachusetts, Mississippi, New Hampshire, Vermont, West Virginia, Washington, and the District of Columbia) do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
For commercial and non-consumer purchases, Silient expressly disclaims all other warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing, course of performance, or usage of trade.
11. Limitation of Remedies and Damages
The remedies in Section 2 are the Owner's sole and exclusive remedies, and Silient's entire liability, for any breach of this Warranty.
Except where prohibited by law, and except for personal-injury damages arising from a Silient design defect that Silient knew or should have known of at the time of sale, in no event shall Silient be liable for any indirect, incidental, consequential, punitive, exemplary, or special damages, including loss of use, loss of profits, business interruption, or cost of substitute goods, whether in contract, tort, strict liability, or any other theory. Silient's total cumulative liability for all claims arising out of or relating to a Silient product shall not exceed the greater of (a) the amount paid by Owner for the specific product giving rise to the claim, or (b) five thousand dollars ($5,000). The foregoing limitations shall not apply to: (i) personal-injury claims where prohibited by law; (ii) gross negligence or willful misconduct; or (iii) any other matter that cannot be limited under applicable law.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may have other rights which vary from state to state.
12. Recall and Safety Notice Cooperation
If Silient determines that a substantial product hazard or other safety concern exists with respect to the Product, Silient will issue a safety notice and may require Owner cooperation in identifying, returning, or remediating the affected product. Owner agrees to cooperate. Continued use of a product after receipt of a Silient safety notice voids this Warranty as to that product.
13. California Proposition 65
WARNING: This product can expose you to chemicals including certain refrigerants and metals known to the State of California to cause cancer or reproductive harm. For more information, go to P65Warnings.ca.gov.
14. Dispute Resolution; Governing Law
Disputes under this Warranty are subject to the binding individual arbitration and class waiver provisions of the Silient Terms of Sale at silient.com/pages/terms-of-sale. This Warranty is governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
15. General
Entire agreement. This Warranty Policy, together with the Silient Terms of Sale and (where applicable) the End Operator Acknowledgement, constitutes the entire warranty between Silient and Owner with respect to the Product.
Severability. If any provision of this Warranty is held invalid or unenforceable, the remainder shall continue in full force and effect, and the invalid provision shall be construed as narrowly as possible to be enforceable.
No waiver. No failure or delay by Silient in exercising any right under this Warranty constitutes a waiver of that right.
Modification. Silient may update this Warranty Policy and the Schedule of Labor Allowances from time to time. Updates apply only to products purchased on or after the effective date of the update; your warranty rights are governed by the Warranty Policy in effect on your purchase date.
